These Terms and Conditions ("Terms") govern your use of services provided by Vijay Trading Company  through its website (https://www.vijaytradingcompany.co.in), mobile application, and associated platforms (collectively, the "Platform"), and the services offered there on (collectively, the "Services"). These Terms include our Privacy Policy (available at https://www.vijaytradingcompany.co.in/privacy-policy),Shipping Policy, Return Policy, and any additional guidelines, policies, or disclaimers issued by us from time to time ("Supplemental Terms"), which form an integral part of these Terms. In case of conflict, Supplemental Terms prevail over these Terms.

Vijay Trading Company is operated by Qualify VTC India Private Limited  a company incorporated under the Companies Act, 2013, with its registered office at __Azamgarh_ and principal place of business at _Azamgarh ("we,""us," or "our"). These Terms constitutea binding legal contract between us and you, a user of the Services or any legal entity booking Services on behalf of end-users ("you," "Customer," or "User").

The company retains the right to amend or modify these terms at any time by updating this page. The revised terms shall take immediate effect upon being posted. Users are expected to review this page periodically, as continued use of the website or services constitutes agreement to the updated terms.

By accessing our website, registering, or using our services, you confirm that you have read, understood, and agree to abide by these terms. If you do not agree to these terms, you must not use the website or services, and the company shall bear no liability for unauthorized access or use.

1. Services

a) Scope:The Platform connects Customers with independent third-party service providers ("Service Providers") for:

 

  • Nizamabad  Black clay Pottery 
  • Mubarakpur saree
  • Online Booking, Marketing, and Trading of Items used in various services, Call Centers, and Customer Support

a) Pro Services: Services rendered by Service Providers are termed "Pro Services."WefacilitatebookingsandpaymentsbutdonotprovideProServices ourselves. Service Providers are independent entities, not employees, agents, contractors, or partners of Vijay Trading Company.

b) OperationalEthos:Ourmottois"SameDay,SameTimeDelivery."Weaimto deliverservicesorproductsonthesamedayandtimeasbooked,primarily

through local Service Providers. For non-local deliveries, standard courier timelines apply (see Shipping Policy).

 

c) Eligibility:You must be at least 18 years old and legally competent under the Indian Contract Act, 1872, to use the Services. Minors may only use the Platform through a legal guardian.

d) Geographical Scope: The Platform is intended for use within India, though international bookings are supported with applicable terms.

e) As a part of the Services QualiFy only acts as a facilitator and the transfer of payments to Service Professionals for the services they render to its users and collects payments on behalf of such Service Professionals.

f) Services rendered by Service Providers are termed "Pro Services." We facilitate bookings and payments but do not provide Pro Services ourselves. Service Providers are independent entities, not employees, agents, contractors, or partners of QualiFy Company. Service Professionals are solely liable and responsible for the Pro Services that they offer or otherwise provide through the Platform. Service Professionals do not have the ability to bind or represent QualiFy.

g) You ascertain that you are at least 18 years old and legally competent under the Indian Contract Act, 1872, to use the Services. Minors may only use the Platform through a legal guardian.

2. AccountCreation

a) Registration: To access Services, you must create an account ("Account") by providingaccuratedetails,includingyourname,phonenumber,emailaddress, and address.

b) Accuracy: You warrant that all information provided is true and will remain accurate. Update your details promptly via the Platform if they change.

c) Security: You are responsible for maintaining the confidentiality of your Accountcredentialsandmustnotifyusimmediatelyofanyunauthorizeduseor security breach at support@qualifycompany.com.

d) Liability: You are liable for all activities under your Account, including by third parties. We are not responsible for unauthorized access.

e) Communications: You consent to receive SMS, email, WhatsApp messages, or push notifications regarding bookings, payments, promotions, and updates. Opt-out by contacting privacy@vijaytradingcompany.co,in, though this may limit Service access.

f) To access certain Services, Users must complete the registration process, which includes providing accurate and complete information, maintaining its accuracy, and updating it as necessary. By registering, you affirm that a) You are at least 18 years old, b) You possess the legal capacity to enter into a binding contract, and c) You comply with all applicable laws and regulations.

g) Upon registration, Users will receive login credentials, which must be kept confidential. Unauthorized sharing or misuse of credentials is prohibited. Users must notify the Company immediately of any unauthorized account activity.

h) The Company reserves the right to suspend or terminate User accounts without notice if any violations of these Terms or the Privacy Policy are identified.

i) Users are responsible for ensuring that all activities conducted under their accounts comply with these Terms. The Company disclaims liability for damages resulting from a user’s inability to access their account due to external fact or such as internet connectivity issues.

3. Booking and Delivery Policy

a) Booking Process: Book Pro Services or products via the Platform by selecting a time slot. We use reasonable efforts to assign a Service Provider for local "same day, same time" delivery or a courier for non-local deliveries.

b) However, same day, same time delivery is not a guarantee and the company shall not be held liable for any deviation from same day same time delivery.

c) Confirmation: Bookings are confirmed via SMS, email, or push notification after you tick "Agree" to these Terms during login or booking.

d) Substitution: If a Service Provider is unavailable, we may substitute another registered Service Provider.

e) Cancellation:

  • Pre-confirmation cancellations are free.
  • Post-confirmation cancellations incur fees as per our cancellation policy (available on the Platform).

f) Delivery: Local- Provided that if any delivery is delayed or is returned from its destination (including as a result of you providing incorrect name or address or other incorrect/misleading information or recipient’s unavailability or refusal to accept the order at the time of delivery), the company shall not be liable for the same/ responsible to make re-delivery. Any costs incurred by the company this respect shall be borne by you. Provided further that, while the company makes best endeavors to ensure that Services are delivered to you within the period reflected at the time of placing the order, the company does not make any representation, guarantee or warranty in relation to the delivery time as the estimated delivery time may be changed without notice and there could be delays for reasons beyond the reasonable control of the company such as availability of third party delivery service providers, demand, traffic and weather conditions, a force majeure event, the location provided by the customer(s), the customer(s) being unresponsive on call, delivery partner(s) facing any on-ground challenges etc.

g) Delivery:

  • Local: Same day, same time delivery via local Service Providers.
  • Non-Local: Courier delivery within 2-7 days (u.p.) or 6-12 days (india), subject to location and item weight.

h) Identification: You may need to provide identification proof to avail certain Services.

4. Pricing,Fees,andPayments

a) Charges: Charges for Pro Services and products are displayed at booking, includingbaserates,additionalfees(e.g.,convenience,safety,orwelfarefees), and taxes.

b) Payment Methods: Options include credit/debit cards, net banking, digital wallets (e.g., UPI), and cash on delivery (COD) where available. We may restrict payment methods at our discretion.

c) CollectionAgent: We act as a limited collection agent for Service Providers, transferring payments after deducting our fees.

d) Taxes:Allchargesincludeapplicabletaxes(e.g., GST).

e) Adjustments:We may adjust prices due to demand, location, or other factors, with changes not affecting confirmed bookings.

f) Refunds: Non-refundable unless specified in the Return Policy or required by law.

g) Third-PartyProcessors:Paymentsmaybeprocessedviathird-partypayment processors, subject to their terms. We are not liable for processor errors.

h) Tipping:TippingServiceProvidersisvoluntaryandnotincludedinpayments.

5. ReturnPolicy

a) General Principle: Most items and services are non-returnable, per our motto "no faulty, no return, no action." Inspect items upon delivery and refuse acceptance if unsatisfactory.

b) Returnable Items: Specific products (marked on the Platform) are returnable within 7 days if:

• Customersubmitsavideoandphotosofdamagesviathe Platform. • Itemsareunused,undamaged,andinoriginalpackagingwith tags.

 

c) Non-ReturnableItems:Includesperishablegoods(e.g.,agriculturalproducts, live animals), hygiene-sensitive services (e.g., cleaning, gardening), and customized items.

d) Process:Approvedreturnsarecollectedviareversepickup(whereserviceable) or self-shipping to [Insert WarehouseAddress]. Refunds are processed within 7-10 working days to the original payment method or as store credit for COD orders.

e) Courier Returns: For items delivered via courier, returns require damage evidence and are subject to the 7-day limit.

6. UserContent

a) Definition: Includes reviews, feedback, suggestions, or other content you submit ("User Content").

b) License: You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, display, modify, and distribute User Content for Service operation and promotion.

c) Warranty: You warrant that User Content is accurate, lawful, and does not infringe third-party rights.

d) Removal:WemayremoveUserContentviolatingtheseTermswithoutnotice.

7. UserConduct

Representation: You represent and warrant that all information that you provide in relation to the Pro Services is complete, true, and correct on the date of agreeing to these Terms and shall continue to be complete, true, and correct while you avail the Services and/or the Pro Services. Should any information that you provide change during the existence of these Terms, you undertake to immediately bring such change to our notice. We do not accept any responsibility or liability for any loss or damage that you may suffer or incur if any information, documentation, material, or data, provided to avail the Services is incorrect, incomplete, inaccurate, or misleading or if you fail to disclose any material fact.

a) Respect: Treat Service Providers courteously and provide a safe, clean, appropriate environment for Pro Services.

b) Discrimination: Discrimination against Service Providers based on race, religion, gender, or other protected traits is prohibited.

c) Reporting:ReportServiceProvidermisconductto grievanceofficer@qualifycompany.comwithin48hours.

d) Restrictions:DonotsolicitServiceProvidersindependentlyorbypassthe Platform for similar services.

8. PrivacyandDataUse

a) Collection:SeePrivacyPolicyfordetailsondatacollectionanduse.

b) Consent:You consent to us sharing data with Service Providers, affiliates, or authorities as required by law or to enhance Services

c) Security:We employ industry-standard measures to protect your data, though no transmission is entirely secure.

9. IntellectualProperty

a) Ownership:AllrightsinthePlatformandServicesareownedbyorlicensedto us.

b) License: We grant you a non-exclusive, revocable license to use the Platform per these Terms.

c) Feedback: Suggestions or feedback you provide may be used by us without compensation or restriction.

10. DisclaimersandWarranties

a) As-Is Basis: Services are provided "as is" without warranties of merchantability, fitness, or non-infringement.

b) NoLiability:Wearenot liableforProServicequality,ServiceProvideractions, or damages caused during service delivery.

c) Risk:You assume all risks from usingServices or solicitingService Providers independently.

11. LimitationofLiability

a) Cap:Ourliabilityislimitedtothecommissionearnedfromabooking,capped at INR 10,000.

b) Exclusion: We are not liable for indirect, consequential, or punitive damages, even if advised of their possibility.

12. Indemnity

a) Youagreetoindemnifyus,ouraffiliates,andofficersagainstclaims,losses,or damages arising from your use of Services, breach of Terms, or third-party actions via your Account.

13. Termination

a) ByUs:Wemayterminateyouraccessimmediatelyforbreachesorwith30days’ notice for any reason.

b) ByYou:Terminatebyemailingprivacy@qualifycompany.com.

c) Effect: Upon termination, your Account expires, and Services cease, thoughsurviving clauses (e.g., indemnity) remain effective.

14. GrievanceRedressal

a) Officer:ContactVijayKumarVermaVicePresident-CustomerExperience,at grievanceofficer@vijaytradingcompany.co.in

b) Process:Complaintsareacknowledgedwithin48hoursandresolvedwithin30 days, per the Consumer Protection (E-Commerce) Rules, 2020.

15. GoverningLawandDisputeResolution

a) This agreement and all rules, policies and documents incorporated by reference shall be governed and construed in accordance with the laws of India and the courts in Azamgarh, Uttar Pradesh, India shall have exclusive jurisdiction without any conflict of law.

b) The parties mandatorily try and settle any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity, or termination (a “Dispute”) amicably.

c) If the parties are unable to resolve the Dispute amicably within a period of 30 (Thirty) days from the date of such reference, the Dispute shall be referred to sole arbitrator as appointed by the jurisdictional court.

d) The arbitration shall be carried out in accordance with the provisions of the Arbitration and Conciliation Act, 1996, amended up to date.

e) The language of the arbitration shall be English and the seat of the Arbitration shall be Azamgarh, Uttar Pradesh.

16. Miscellaneous

a) Amendments:WemayupdatetheseTerms,effectiveuponposting.Continued use constitutes acceptance.

b) Force Majeure:We are not liable for delays due to events beyond our control (e.g., natural disasters, strikes).

c) Severability:InvalidprovisionsdonotaffectremainingTerms.

d) Assignment: You may not assign these Terms without our consent; we may assign them to
